Welcome to Fallen Neogods (“Fallen Neogods,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of fallenneogods.xyzand any related pages, tools, and features (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and legally able to enter into these Terms. By using the Service you represent that you meet these requirements and that your use complies with all laws that apply to you.

2. The Service

Fallen Neogods is a community platform for a digital-collectible project. It may include an informational site, holder-gated tools (such as an AI art studio), a loyalty-points system, community giveaways, and links to third-party marketplaces and social platforms. Features may change, launch, pause, or be removed at any time.

3. Accounts

You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Provide accurate information and keep it current. One person may not maintain multiple accounts to abuse features. Notify us promptly of any unauthorized use.

4. Wallets & Holder Verification

Some features require you to connect a self-custodied crypto wallet and cryptographically sign a message to prove you hold an eligible collectible. We do not take custody of, hold, or control your wallet, keys, or assets, and we never ask for your seed phrase or private keys. You are solely responsible for your wallet and its security. Blockchain transactions are irreversible and outside our control.

5. Favor

“Favor” is a non-monetary loyalty and engagement point used within the Service (for example, for cosmetics, community giveaway entries, and standing). Favor is not a currency, security, financial instrument, or token; it has no cash value, cannot be redeemed for money, and carries no promise of any future token, airdrop, conversion, or financial return. We may adjust, expire, recalculate, suspend, or remove Favor and its earning rates at any time.

6. Digital Collectibles & Blockchain Risks

Digital collectibles referenced by the Service exist on public blockchains and are traded on third-party marketplaces that we do not operate or control. We do not guarantee the value, availability, authenticity, or continued existence of any collectible. Crypto-assets are volatile and risky; you may lose value, and you use them at your own risk. Nothing here is an offer to sell or a solicitation to buy any asset.

7. The Forge & Generated Content

Tools that generate images or other content (the “Forge”) are provided for personal, non-commercial community use unless we say otherwise. Outputs are generated by third-party AI systems and may be imperfect or unexpected. You may not use these tools to create unlawful, infringing, hateful, or harmful content, and you are responsible for how you use any output.

8. Community Features & Giveaways

Giveaways, raffles, and similar community features are promotional and run at our discretion. Eligibility requirements, entry costs (in Favor), and winner selection are as described at the time. Favor spent on entries is not refundable. We may cancel or modify any promotion. Where required, promotions are void where prohibited.

9. Acceptable Use

You agree not to: break the law or others’ rights; interfere with or disrupt the Service; attempt to gain unauthorized access; scrape, overload, or abuse our systems or APIs; exploit bugs or manipulate Favor, verification, or giveaways; or use the Service to harass, deceive, or harm others. We may suspend or terminate access for violations.

10. Intellectual Property

The Service, including its branding, text, graphics, and code, is owned by Fallen Neogodsor its licensors and protected by law. Any rights you hold in a collectible you own are governed by that collectible’s own license and are separate from these Terms. You may not copy, resell, or exploit the Service except as expressly permitted.

11. No Financial or Legal Advice

Nothing on the Service is financial, investment, tax, or legal advice. Collectibles and crypto-assets are not offered as investments, and no profit or return is promised. Do your own research and consult your own professionals before making decisions.

12. Third-Party Services

The Service relies on and links to third parties (for example, marketplaces, wallet providers, social platforms, and infrastructure vendors). We are not responsible for third-party services, their content, or their terms. Your use of them is governed by their agreements.

13. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

14. Limitation of Liability

To the fullest extent permitted by law, Fallen Neogods and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or crypto-assets, arising from your use of the Service. Our total liability for any claim will not exceed one hundred U.S. dollars (US$100).

15. Indemnification

You agree to indemnify and hold harmless Fallen Neogods and its team from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or the law.

16. Changes & Termination

We may modify the Service or these Terms at any time; material changes take effect when posted, and your continued use means you accept them. We may suspend or terminate your access at any time, including for violations of these Terms.

17. Governing Law

These Terms are governed by the laws of Texas, United States of America, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located there, except where prohibited by law.
